Planning Board members were hoping the developer of the proposed 135-lot Aro Estates project would be offering an olive branch as a settlement agreement during Monday’s meeting.
Instead, Kevin O’Brien, of O’Brien Homes Inc., brought a twig.
O’Brien sued the Planning Board and the Town of Lunenburg in June after the Board denied the proposed subdivision off Howard Street.
The lawsuit challenged the validity of the town’s zoning bylaw related to cluster development and alleged that it was unconstitutional as applied to Aro Estates.
O’Brien, with his attorney, Diane Tillotson, of Boston, came before the Board Monday looking for a way to move forward in a “positive manner.”
